S&K Famous Brands Rejection of Leases and Executory Contracts

Attention Landlords and Recipients of Deferred Compensation from S&K Famous Brands, Inc. (dba S&K Menswear)

On Monday, February 9, 2009, S&K Famous Brands, Inc. (“S&K”) of Glen Allen in Henrico County, Virginia filed for protection under Chapter 11 of the Bankruptcy Code in the Bankruptcy Court for the Eastern District of Virginia, Richmond Division, on Monday, February 9, 2009, case number 09-30805.

 

Rejection of Leases & Executory Contracts:

As of its first day motions, S&K is proposing to reject 79 leases and 22 executory contracts. Landlords and those objecting to the rejection must do so by counsel. The objection deadline is February 20, 2009. All those individuals affected by this motion need to file their objections on or before February 20th.

 

Additionally, S&K filed a motion on February 12, 2009 seeking that the assets of a Rabbi Trust established as part of the deferred compensation system be turned over to S&K. S&K has filed a motion to expedite the hearing of this motion. Absent objection to the motion to expedite, the hearing on the motion to turnover the assets of the Rabbi Trust to S&K will be held February 18, 2009.
